Jumping Jacks Play LLC – Participation Waiver and Release of Liability

Business: Jumping Jacks Play LLC (“Jumping Jacks Play,” “we,” “our”)
Acknowledgment and Assumption of Risk
I understand that activities at Jumping Jacks Play involve indoor play structures, toys, and equipment that may expose participants to risks of injury, including falls, collisions, and other accidents.
I acknowledge that these risks are inherent and cannot be completely eliminated even when reasonable care and supervision are provided.
By signing this agreement, I knowingly and voluntarily accept and assume all such risks for myself and for the child(ren) or minor(s) listed below.
Release and Waiver
In consideration of being permitted to enter and participate in play, classes, events, or parties at Jumping Jacks Play, I, for myself, my child(ren), our heirs, executors, and representatives, hereby release, discharge, and hold harmless Jumping Jacks Play LLC, its owners, members, employees, volunteers, and agents from any and all claims or causes of action for injury, illness, property damage, or other loss arising from participation or presence on the premises, to the fullest extent permitted by Massachusetts law.
I understand that this waiver does not release claims for gross negligence or reckless or intentional conduct, as prohibited by law.
Parental/Guardian Consent
I represent that I am the parent or legal guardian of the participant(s) named below, or I have obtained permission from such parent or guardian.
I understand that Massachusetts law may limit a parent’s ability to waive a minor’s right to sue, but I intend this agreement to demonstrate our understanding and voluntary assumption of the risks involved in participation.
Rules and Conduct
I agree to follow all posted safety rules, facility policies, and staff instructions.
If I observe any unsafe condition, I will immediately report it to a Jumping Jacks Play employee.
I understand that Jumping Jacks Play is a no-shoes facility, and food or beverages must stay in designated snack areas.
Medical Authorization
In the event of an injury or medical emergency, I authorize Jumping Jacks Play LLC and its staff to obtain or provide medical treatment deemed necessary for the participant(s).
I agree to be financially responsible for any medical care provided.
Photo/Video Release (Optional)
I grant Jumping Jacks Play LLC permission to use photographs or videos taken during participation for marketing and social media purposes without compensation.

Acknowledgment of Understanding
I have carefully read this waiver, fully understand its terms, and sign it voluntarily.
I acknowledge that by signing, I am giving up certain legal rights and agree to be bound by its terms.
